By purchasing, activating, or using an Alcocheck session ("the Service"), you agree to these Terms & Conditions in full. If you do not agree, do not use the Service.
Alcocheck is a novelty entertainment device. It is not a certified, calibrated, or medical-grade breath-testing device, and it is not a legal or forensic alcohol-testing instrument. Any reading, score, or result ("Result") is indicative only, may be inaccurate, and is provided for amusement and social/photo purposes.
A Result must never be used, and is not intended to be used, to decide whether you or anyone else is fit to drive, operate machinery, or perform any safety-sensitive activity. A low or "sober" Result does not mean it is safe or legal for you to drive. Only a certified law-enforcement or medical device can determine legal fitness to drive. You should always assume you should not drive after consuming any alcohol, and arrange alternative transport.
The Service is intended for use only by individuals who have reached the legal drinking age in the jurisdiction where the Service is used. By using the Service, you confirm you meet this requirement.
You use the Service voluntarily and at your own risk. You accept that the Service involves consumer-grade sensor hardware, that Results are approximations only, and that Alcocheck and the hosting venue make no guarantee of accuracy, availability, or fitness for any particular purpose.
To the maximum extent permitted by applicable law, Alcocheck, its officers, employees, and partner venues shall not be liable for any direct, indirect, incidental, or consequential loss, injury, or damage arising from use of, or reliance on, the Service or any Result — including but not limited to decisions about driving, drinking, or other activity made on the basis of a Result. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law (for example, liability for death or personal injury caused by proven gross negligence, where such exclusion is not permitted).
You agree to indemnify and hold harmless Alcocheck and its partner venues from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your reliance on a Result, or your breach of these Terms.
The Service does not ask for your name, email, or any account, and does not identify you. Breath Results appear on the kiosk's nightly leaderboard under a randomly generated nickname and are cleared automatically each morning.
If you use the photo booth, the photos from your session are uploaded to our servers so that we can deliver them to you through the QR code or link shown on the kiosk. Those photos are deleted automatically 7 days after your session, at which point the link stops working — please save anything you want to keep before then. See our Privacy Policy for full detail on how we handle this data.
You are responsible for what you photograph. Do not photograph anyone who has not agreed to be in the picture, and do not capture content that is unlawful, offensive, or infringes anyone else's rights.
If you give your consent at the kiosk, Alcocheck and the hosting venue may use photos from your session for marketing and advertising purposes — for example on our website, on social media, and in printed or digital promotional material — without further notice, approval, or payment to you.
Giving this consent is entirely optional and is never required in order to use the Service. You may withdraw it at any time by emailing privacy@alcochecker.com; we will stop using the photo going forward, although we cannot always recover material that has already been printed, published, or shared onward. If you do not give consent, your photos are used only to deliver them to you and are deleted on the schedule described above.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, merchantability, or fitness for a particular purpose.
These Terms are governed by the laws of Sweden, without regard to conflict-of-law principles. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
